Next Round: KIIS & KISS in Australia

Dance music station KISS-FM in Melbourne indicated that it is applying to the Federal Court in Australia for order restraining KIIS, owned by Australian Radio Network, from using the brand in Australia. Exactly what orders KISS FM are seeking is unclear from their release.

As negotiations with ARN have lead nowhere Kiss FM will be seeking a resolution with an application to the Federal Court to stop ARN’s dishonest actions.

In a punchy release, the Melbourne dance station is pre-emptively accusing ARN’s KISS of one day infringing its trade marks once registered. There’s many large assumptions loaded into that and the process will not be easy if ARN were to object which it legally is entitled to do – whether that’s a smart PR move is a whole different story.
